1. About these terms
These Terms & Conditions ("Terms") govern your use of Swiggo’s website, waitlist, accounts, promotions, and the purchase of our products (Pure Kienyeji chicken, eggs, day-old and grown chicks, feed and related items). Swiggo is operated by Swiggo Limited, a company registered in Kenya ("Swiggo", "we", "us"). By creating an account, joining our waitlist, entering a promotion, or placing an order, you confirm that you have read, understood and agree to these Terms. If you do not agree, do not use our services.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract under the laws of Kenya to use our services. You are responsible for providing accurate information and for keeping your account details current.
3. Your account
Accounts are secured by your phone number and a one-time code (and optionally an email and password). You are responsible for activity on your account and for keeping access to your phone/email secure. Tell us promptly if you believe your account has been used without your permission.
4. Pre-launch, waitlist and availability
Swiggo is building capacity. Joining the waitlist or expressing interest does not create an order or guarantee that any product, quantity, price or date will be available. Details shown before ordering opens are indicative and may change. Where an item is not yet available we may show an expected date and fulfil once the batch matures.
5. Orders, prices and payment
When ordering is available, prices are shown in Kenyan Shillings at checkout and may change over time. An order is confirmed once payment is received in full, unless our team has agreed different terms with you directly. Payments may be processed through third parties (e.g. M-Pesa / our payment partners); you agree to their handling of your transaction. We may decline or cancel an order (including for pricing errors, stock, suspected fraud, or reasons of animal welfare) and will refund any payment taken for a cancelled order.
6. Delivery and pickup
Pickup is available at our Makindu farm and our Nairobi collection point. Delivery is available within stated Nairobi zones for a fee shown at checkout. Delivery and fulfilment dates are estimates. Risk in perishable and live products passes to you on collection or delivery; please follow any care guidance we provide.
7. Live animals and perishable goods
Chicks and other live birds are living animals. We take care in how they are raised and handled, but once they leave our care their health and growth depend on your husbandry, feed, housing and biosecurity. Except as required by law, we do not guarantee survival, growth rates, laying rates, or yields for birds after handover, and we are not liable for outcomes outside our control. Eggs and dressed chicken are perishable and must be handled and stored appropriately.
8. Promotions and giveaways
Promotions (including the free-chicks giveaway) are subject to any specific rules we publish for them and to these Terms. Entry, eligibility and the selection of winners are at Swiggo’s reasonable discretion; our decisions are final. Prizes are not transferable or exchangeable for cash unless we state otherwise. Where a promotion involves a third-party platform (e.g. TikTok, Instagram, Facebook), that platform is not a sponsor of and is not responsible for the promotion, and you must also follow that platform’s rules. You are responsible for any taxes on a prize.
9. Communications and consent
By creating an account or joining, you agree that we may contact you by SMS, WhatsApp and email about your account, orders, the waitlist, promotions and service updates. You can opt out of marketing messages at any time (e.g. reply STOP to SMS, use the unsubscribe link in emails); we will still send essential service messages relating to your account or orders.
10. Data and privacy
We collect the information you give us (such as name, phone, email, delivery area and order details) and use it to operate your account, fulfil orders, run promotions, communicate with you, and improve and secure our services. We share data with service providers who help us operate (for example messaging and payment providers) and where required by law. We keep information for as long as needed for these purposes and to meet legal obligations. We aim to handle personal data in line with the Kenyan Data Protection Act, 2019. 11. Acceptable use
Do not misuse our services: no unlawful activity, fraud, interfering with or attacking our systems, scraping, impersonation, or infringing others’ rights. We may suspend or close accounts that break these Terms or that we reasonably believe are being misused.
12. Intellectual property
The Swiggo name, logo, site content and materials are owned by or licensed to Swiggo and may not be copied or used without our permission, except as needed to use our services normally.
13. Disclaimers
Our services and information are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we exclude implied warranties and do not guarantee that the service will be uninterrupted or error-free. Nothing in these Terms limits any rights you have that cannot be excluded under Kenyan law.
14. Limitation of liability
To the fullest extent permitted by law, Swiggo is not liable for indirect, incidental or consequential losses, or for loss of profit, revenue, animals, or data arising from your use of our services; and our total liability for any claim relating to a product or order is limited to the amount you paid for that product or order. Nothing here excludes liability that cannot be excluded by law (such as for death or personal injury caused by our negligence, or fraud).
15. Indemnity
You agree to cover reasonable losses we suffer arising from your breach of these Terms or your misuse of our services.
16. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "last updated" date and may ask you to accept the new version before continuing to use your account. Continuing to use our services after an update means you accept the updated Terms.
17. Governing law and disputes
These Terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute. We would rather resolve things directly — please contact us first and we will try to sort it out.
